Bombay High Court: Preserve subscriber, call detail record of Jitendra Awhad

The Bombay Supreme Court has ordered police to ask broadcasters not to delete subscriber details (SDRs) and call data (CDRs) of Maharashtra Minister Jitendra Awhad and police officers who were stationed in his bungalow about a year ago. Awhad is the cabinet minister in Maharashtra.

For the detention of criminals involved in crimes, this is often a necessity for law enforcement authorities to obtain SDRs and CDRs for mobile phones from service providers.

According to lawyer Abaad Ponda, this data is automatically deleted by mobile companies until and unless there are specific orders to keep it.

“The electronic evidence of the respective gentleman and the police must be preserved. In one year, all digital details will be destroyed. One year passes this Sunday. SDR and CDR must be retained. This is not blamed, eh innocent. On Sunday, it will be deleted from the system. If telecommunications companies delete SCR and CDR they were not ordered to keep them, ”begged lawyer Abaad Ponda, appearing as engineer Anant Carmus.

Attorney General Ashutosh Kumbhakoni, who appeared before the state, said: “We have already filed the indictment and everything that is against the accused is being sent to the forensic laboratory. I have no idea about deleting other people’s data. “

According to petitioner Karmuse, He is alleged to have been beaten in Awhad’s bungalow in April 2020. 10 to 15 men for posting a morphed photo of the NAC leader on social media.
In his request, Carmus requested that Awhad’s name be included as a defendant in the FIR, filed by Thane police on the matter.

The Supreme Court will now hear Carmus’ petition on April 21.
